Plans and organizes how investigations will be conducted. Reviews reports drafted by subordinates. Interviews subjects of investigation, complainants, and witnesses using prescribed procedures.
Conducts legal research and locates the section of applicable federal and/or state law, rule or policy relevant to the complaint under investigation. Locates witnesses and obtains facts and evidence needed by attorneys in litigation of cases. Keeps records and makes oral and/or written reports of all investigations. Conducts investigations regarding claims of fraud, employment complaints, damage to state property, and/or on call 24/7 for emergency callouts involving serious accidents, road closures, highway safety/damage, construction zone incidents, hazardous spills, and other incidents deemed necessary. Conducts investigations regarding claims made against the State and testifies in the judicial and quasi-judicial forums. Explains the statutes, rules and regulations to the parties in violation. Analyzes and evaluates information gathered through investigative techniques to determine source reliability, content validity, and potential truthfulness develops investigative leads and links distinguishes patterns, trends and associations develops potential evidence. Pay Grade: 14 Typical Duties and Responsibilities Travel is required and the position is on call 24/7 for emergency incidents. Duties are varied and involve different and often unrelated processes and methods. The employee uses independent judgment in the interpretation and adaption of policies and guidelines. The successful applicant must be discreet and tactful in safeguarding sensitive information and be able to work with and maintain confidential information. Accident investigation and reconstruction experience preferred. The incumbent in this position will conduct statewide complex field investigation of internal employee misconduct of fraud, waste, abuse, Equal Employment Opportunity (EEO), and/or other policy or criminal violations involving department personnel claims for damage filed against the West Virginia Department of Transportation- Division of Highways (WVDOT- DOH) in the West Virginia Legislative Claims Commission (WVLCC), Circuit and Magistrate Courts crashes that occur on West Virginia public highways incidents/equipment failures for the state level Equipment Operator Accountability Board report writing locate witnesses gathers evidence assists attorneys with Freedom of Information Act (FOIA) requests testify in court and other investigations/duties as assigned. Involves complex direct public contact work, as well as contact with insurance company representatives, lawyers, and law enforcement personnel. The Transportation Investigator position works under the Executive Division, Division Director, Attorney Manager and/or Investigator Senior, performing advanced level investigations by obtaining evidence of reported fraud, or violations of the rules and regulations of a state agency or of state or federal laws or involving claims for damages by or against a state agency.
